GENERAL TERMS AND CONDITIONS OF CONTRACT AND USE
Welcome to the website ateliermarinamarin.com (hereinafter, the "Site").
The Site is the exclusive property of Atelier Marina Marin, with registered office in Milan (MI), Via Iglesias 38, ZIP 20128, VAT No. 11182070968 (hereinafter, "Atelier Marina Marin" or the "Seller").
Access to, browsing of, use of the Site and the purchase of products through it are governed by these Terms and Conditions (hereinafter, the "Conditions"). By browsing or making a purchase on the Site, the user declares that they have read, understood and fully accepted these Conditions, together with the Privacy & Cookie Policy.
1. Intellectual and Industrial Property
- Works of Authorship: All materials on the Site (including trademarks, logos, texts, photographs, images, sketches, videos, designs, patterns and software) are the exclusive property of Atelier Marina Marin.
- Copying Prohibited: Any reproduction, modification, distribution, transmission or commercial use of any content is strictly forbidden without the prior written consent of the Owner.
- Design Protection: The models and tailoring creations shown on the Site are works of authorship protected by copyright and industrial property laws.
2. Appointment Booking and Fitting Service
- Consultation Request: Through the Site you can request an appointment for a consultation or a dress try-on (fitting) at the Milan Atelier.
- Appointment Confirmation: The request sent via the Site form does not constitute an automatic booking. The appointment is valid only after written confirmation (by email or WhatsApp) from the staff.
- Cancellation Policy: Given the exclusivity of the artisanal service, the user must notify any cancellation or change of the appointment at least 24/48 hours in advance.
3. Made-to-Measure and Haute Couture Creations in Atelier
- In-Store Process: The information on products and made-to-measure services on the Site is for informational purposes only.
- Dedicated Contracts: Any order for bridal, ceremony or made-to-measure haute couture garments made physically in the Atelier will be governed by a specific paper or digital contract signed by the parties.
4. E-commerce Sales Conditions (Online Purchases)
- Order Acceptance: A purchase on the Site is deemed completed only when the user receives the "Order Confirmation" email from Atelier Marina Marin.
- Prices and Payments: All prices are in Euro (€) and include VAT. Payments are handled through secure systems indicated during checkout.
- Product Availability: As these are artisanal productions, in the event of subsequent unavailability of a fabric or product, the Atelier will promptly inform the customer and proceed with a full refund of the amount paid.
5. Right of Withdrawal and Returns (Exclusions for Customized Items)
- Standard Products: Pursuant to the Consumer Code (Legislative Decree 206/2005), for standard products purchased online (not customized), the Customer has the right to withdraw from the contract within 14 days of receiving the goods. Return shipping costs are borne by the customer.
- Exclusion of Withdrawal: The right of withdrawal DOES NOT apply to the supply of goods made to measure or clearly personalized (e.g., special tailoring alterations, embroidered initials, custom color requests), as provided by art. 59, letter c) of the Consumer Code.
6. Limitation of Liability
- Visual Rendering: Atelier Marina Marin undertakes to represent colors and fabrics as faithfully as possible. However, absolute color matching cannot be guaranteed due to the digital rendering of different monitors.
- Service Continuity: The Atelier shall not be liable for any damages arising from temporary inaccessibility of the Site, network interruptions or computer viruses.
7. Applicable Law and Competent Court
- Jurisdiction: These Conditions are entirely governed by Italian law.
- Exclusive Venue: For any dispute arising from the interpretation, validity or performance of these Conditions, the Court of Milan shall have exclusive jurisdiction. If the user qualifies as a consumer, the mandatory court of their residence or domicile shall apply.
